Divorce Preparation

Divorce preparation varies from divorce to divorce. However if you are planning to file a divorce, following divorce preparation pointers will make you better prepared to face a divorce:

Make a Decision

Know thyself! If you have decided to go for divorce, think this decision over. Is it really what you want or what? Is there any hope of reconciliation? Rethink and reach a final unwavering decision.

Separating the Accounts

After the final decision about divorce, you should get down to making yourself financially secure. It is a major step in divorce preparation. Separate your bank account. If you have a joint account with your spouse, open a savings or checking account in your name only.

Credit Cards

If you do not have any credit cards and you are going for a divorce, then it is the right time to apply for a credit card. You never know when you may need extra cash.

Emotional Injuries

Develop relationship with a therapist or make friends who help you heal emotionally and help you in living separately. Emotional backup is important in divorce preparation.

Hire a Divorce Attorney

You must consult with a divorce attorney and hire him/her for your divorce. If you don’t want to acquire services of any divorce attorney and want to represent yourself in the court, you can do it. But it is recommended to hire the services of a divorce attorney.

Inform your Family and Friends

Before claiming a divorce, it is advised to consult with your family and friends and also consider what they say about your divorce. Preparation for divorce will be easier once you have the approval of your family and friends.

Gather the Information

Collect all the information of assets, liabilities and bank statements, and review it thoroughly. Once you start your divorce preparation, it is recommended to prepare a list of:
  • Your personal assets
  • Marital assets
  • Assets purchased after separation

Child Custody

It is better to decide the child custody mutually before a divorce. If you are unable to agree on this issue, the divorce court will consider the best interest of the child in assigning the custody and visitation rights.

Child Support

Child support is also a big issue and it is advised to resolve without taking it to a divorce court. The court considers gross income of the non-custodial spouse and places a percentage to it that must be paid every month to the other spouse for child support. The other things the court considers are the living standards, medical and educational facilities etc.

Spousal Support

Spousal support or alimony is the money paid by one spouse to another for financial support. Consult a divorce attorney to help you with chalking out the expected alimony you or your spouse will be required to pay according to the divorce laws of your state.

Divorce preparation will prove helpful in the long run. Not only you will be able to face pre-divorce and divorce situations but it will also equip you to face post-divorce problems.
